Asylum is a form of protection granted to a refugee already in the United States who is either unable or unwilling to return to his or her home country, for the fear of persecution because of race, religion, nationality, political view, and membership in a particular social group.

A person who is granted asylum can live and work in the United States legally. An individual is also allowed to apply for asylum regardless of immigration status, which means the person can enter the United States illegally and still be allowed to apply for asylum. However, in such a case if the Asylum application is rejected, the person is likely to be deported immediately.

How to Seek Asylum in the United States?
 
An individual seeking asylum can -

1. Ask for asylum at a port-of-entry

2. File an application within one year of arrival in the US

3. Apply for asylum, even beyond the one year limit, if conditions in one's country have changed or if personal circumstances have changed within the past year prior to the application for asylum and those changes have affected his or her eligibility for asylum

4. Apply for asylum under the existence of extra-ordinary circumstances that prevented the applicant from applying for asylum within the stipulated one year.
